The Civil Procedure Reform

(Department of Civil Law)

Civil contentious procedure is currently governed by Civil Procedure Code No. 99/1963 Coll. This act arose in other socio-political circumstances and was originally based on an ideological conception that is unacceptable today. After a series of novelties that have been adopted gradually since 1989, the Civil Procedure Code today is totally unclear and in many respects a non-compliant law that deforms or totally lacks regulation of many classical institutes of civil contentious proceeding and which lacks any concepts. The reform is inevitable in this respect. This summer was finalized draft of the basic points of new civil procedure code, setting out the direction for future regulation. The conference will address not only this paper, but also the problems of the current civil procedure code and the possibilities of overcoming them. A welcome enrichment will be the contributions, which will present a foreign experience with the reform of the civil contentious proceedings.
